Chapter 7

For most Chapter 7 cases, normal attorney’s fees are $1,500. Attorney’s fees could be higher or lower depending on each specific case. In addition to attorney's fees, other fees will be required. A filing fee of $299 is paid to the U.S. Bankruptcy Court prior to filing the case. Two required courses, a pre-filing credit counseling course and a post-filing financial management course, cost about $50 each. Both courses can be initially taken on-line with a follow-up telephone session with the counseling agency. The client pays the counseling agency directly for these 2 courses.

Additional attorney’s fees based on an hourly fee may be required if a creditor files a complaint to determine dischargeability of debt or if there are other specific circumstances. The  attorney hourly fee is $150.00.

Chapter 13

For most Chapter 13 cases, attorney’s fees start at $3,000. Most of these fees can be paid through the plan. The filing fee which is paid to the U.S. Bankruptcy Court is $274. The two counseling courses described above are also required for a Chapter 13 case.

As stated above, additional attorney’s fees based on an hourly fee may be required based on specific case circumstances.
